Parents sue after daughter raped in school's gender-neutral bathroom

Parents in Oregon have filed a lawsuit against the school district after a student sexually abused and raped their daughter in a gender-neutral bathroom. This is not the first such case in the United States.

The parents’ lawsuit claims that the school district failed to protect their disabled daughter from being raped in a gender-neutral school bathroom during school hours, writes the Post Millenial website.

The female student was sexually assaulted and raped by a classmate who was allowed to roam the hallways unsupervised, the lawsuit says. It further argues that the district should have been aware of the perpetrator’s “behaviors and proclivities” and not have allowed him to roam freely on school property during school hours.

In response to the lawsuit, a spokesperson for the district said: “The District does not comment on pending litigation and assures the community that TTSD is committed to the safety of every student in our schools. Allegations of sexual assault are serious, and Oregon law and District policy require the investigation of such reports. TTSD responds urgently with support for students experiencing any form of violence. The District is committed to holding anyone accountable who is responsible for serious criminal offenses,” the spokesperson added.

Following the assault, the student was transferred to a new school, according to Kevin Brague, the lawyer representing the family. The lawsuit seeks $3.7 million in damages, which includes compensation for non-economic damages as well as the costs of medical care and therapy related to the incident.

This is not the first such case in the US. In recent years, a case involving a girl who was raped in a women’s bathroom by a transgender schoolmate has stirred quite a controversy. The attacker, who identified as female, was permitted to use the women’s facilities.

The family of a teenage girl who was raped in the bathroom has sued Loudoun County Public Schools in Virginia for $30 million over accusations that the school district failed to adequately investigate and that it attempted to cover up the sexual assault.

The student accused of rape was charged after the assault and barred by court order from returning to Stone Bridge. The attacker was then transferred by administrators to another school in the district, Broad Run High School, where the student sexually assaulted another girl in an empty classroom in October 2021. The attacker, who was 15 at the time, was convicted as a juvenile in both cases.

In the lawsuit, the family alleges that the district lied to the public to cover up the May assault because it was working to advance Policy 8040, which allows students to use bathrooms and locker rooms that correspond with their gender identity. The policy had not been implemented at the time of the assault, – according to an earlier piece on the Fox News website.
